Application for the procedure of legalization

Geodetic snapshot

Initially, the bylaw on legalization (02/11/2009), article 10, stated that a geodetic snapshot done on the copy of the plan was needed for the legalization of an object. That copy of the plan could not be older than 6 months.

Because of the huge backlog of requests in the Geodetic authority, in an annex of the bylaw on legalization (05/02/2010), article 5, the Ministry removed the need of the snapshot to be "done on the copy of the plan of the parcel". It also changed the content of the requested geodetic snapshot. That snapshot now needs to have:

  • the object that is subject to legalization marked with at least two points of the front facade (Gauss–Krüger coordinate system) together with all the other objects that may exist on that parcel
  • gross developed construction surface of the base of the object
  • mark (number) of the parcel in the land register
  • number of floors
  • marks of the neighboring parcels
  • positions of the neighboring objects
  • orientation of the parcel regarding cardinal points
  • position of infrastructure connection
  • position of underground installations
  • absolute height marks

The Annex (05/02/2010), requests a geodetic snapshot that has more data than what was defined in the initial Bylaw (02/11/2009). This makes the geodetic services more expensive.

Strictly following this new rule will force people, who already did the geodetic snapshot based on the initial bylaw and/or have their object marked on the copy of plan issued by the Geodetic Authority, to redo or complete the geodetic snapshot. The only exception could be those, who submitted their project of as-built state, at most 60 days, after the New Law came in to force (11/09/2009).

Photographs

In the New Law on Planning and Construction (11/09/2009), article 188 and 189, and in the related bylaw (05/02/2010), article 9, it is specified that, 4 photos of the object submitted for legalization are needed, showing the object's facade on each side. Minimal dimensions of photographs is 100x150mm, black-and-white or color. If the concerned object has been reconstructed, photos must show the object from inside as well.
