Application for the procedure of legalization
In the articles 188 and 189 of the New Law on Planning and Construction (11/09/2009), is it specified that, in order to complete the application for the legalization of one object, one must have either:
- a proof of ownership (property rights by the New Law) for the parcel on which the object submitted for legalization is built
- a lease contract for the parcel on which the object submitted for legalization is built
- or a proof of property rights on the object itself
Very importantly, the Annex (05/02/2010) of the bylaw on legalization (02/11/2009) added the possibility to submit a proof of the rights of use (usership by the former law). Practically, most of the people who want to legalize an object have a proof of their rights of use on the parcel where is the object. That is now accepted.
